What Is a Pour-Over Will and Why You Might Need One

A pour-over will is a legal document that states all of the assets of an individual at the time of their death should be transferred to their trust. This ensures that any assets that were not already in the trust at the time of death are poured over” into the trust after death. It can be necessary in certain situations

such as when a person has forgotten to add certain assets to the trust before passing away

or when they acquire new assets after the trust has been set up but before passing away.”

Key Considerations for Creating a Pour-Over Will

1. Include all of your assets in the pour-over will. You should list all of your real estate, investments, bank accounts, and other property that you own.

2. Make sure that you clearly identify your beneficiaries. You should include the full name, address, and relationship to you of each beneficiary.

3. Specify how you want your assets distributed. You should include specific instructions for who should receive what assets and how much they should receive.

4. Select an executor for your pour-over will. An executor is the person responsible for carrying out the provisions in your pour-over will.

5. Name a guardian for any minor children. You should name a guardian to take care of any minor children in case something happens to you and your spouse.

6. Sign the pour-over will in front of witnesses. In order for your pour-over will to be legally valid, it must be signed in front of two witnesses.
